The Maritime Union of Australia prepares for industrial strike in Pilbara for the first time in 17 years

Australia’s economic engine room is heading for its first industrial strike in 17 years, with the wharfies union preparing to down tools in the resources-rich Pilbara. The Maritime Union of Australia is poised to strike at Port Hedland after failing to reach agreement with the State Government over housing and salaries. The union is using Wednesday’s no-vote on the Port Hedland general employee agreement, which has been in play for more than a year, as the trigger for industrial action. “Given the agreement received a majority no-vote we will now prepare for protected industrial action,” MUA North-West regional organiser Joel O’Brien said. “This will likely affect day-to-day running of the port and disrupt copper and lithium exports at Eastern Harbour and iron ore exports at Utah Point. “It would also likely affect the construction of Lumsden Point, where the Federal Government has committed $450 million for its construction.” Gina Rinehart’s Atlas Iron and Chris Ellison’s Mineral Resources use Utah Point, a berth at Port Hedland that has a 24 million tonne-a-year capacity. Atlas Iron and MinRes each export about 10 million tonnes of iron ore annually through the port. MinRes also exports 220,000 tonnes of lithium spodumene from the Wodgina mine. The Pilbara Port Authority said the 166 employees covered by the agreement in question were “predominantly in office-based roles, or operational support roles such as maintenance, storepersons and administration.” “No application has been made to the Fair Work Commission for a protected action ballot order, and we have not been contacted by the MUA in relation to this possibility,” a spokesperson said. “Given the supporting role that our employees perform within the port, protected action would have no impact on port throughput.” Mr O’Brien said the State-run Pilbara Ports Authority had refused to budge on key points relating to pay disparities. “In 2017 the company introduced two schedules of rates, where all existing employees were on one schedule and anyone employed after 2017 were on $30,000 to $40,000 less per year for the working the same job, which has caused a lot of cultural issues on site. “Our claim for salaries is that all schedule two salaries rise immediately to meet the higher schedule one salaries.” The MUA claimed the port’s solution would have seen some workers take a pay cut. In a note sent to members ahead of this Wednesday’s vote, Mr O’Brien said the Authority was hiding behind the WA Government’s wages policy. “One part of the policy states the following: in considering and making offers during bargaining, the Government will place a specific emphasis on, delivering wage increases and conditions that are reasonable in the context of each negotiation and financially sustainable,” Mr O’Brien said. “The company can easily afford to lock housing in the EA and lift all employees immediately to schedule one, the latter representing only about one per cent of the company’s recent net profit after tax of $246,800,000.” The MUA is now balloting members about whether to file an application to the Fair Work Commission for the right to strike, with the first day of action occurring in as early as two weeks. It would be the first industrial action in the Pilbara since 2008, when Rio Tinto train drivers walked off the job. “We are seeing the early signs of a period of disruption and industrial uncertainty in the Pilbara, a region that underpins Australia’s economic success,” Minerals Council of Australia boss Tania Constable said. “Through a raft of changes to workplace law, unions have been handed the power to drag Australia’s most productive, wealth-generating region back to the strike-ridden days of the 1970s. “This imminent return of strikes across mine sites and ports would reverberate throughout the Western Australian economy and beyond.” Chamber of Minerals and Energy WA chief executive Rebecca Tomkinson said the action would imperil “harmonious and stable bargaining directly between employers and their workers (that) have delivered wages that are today 57 per cent higher than the national average.” “When wage rises are linked to productivity gains, both businesses and workers are able to thrive at the same time,” she said. “Threats of industrial action at a key export terminal at the Port of Port Hedland are a concerning development. “Unions play an important role but the militant unionism of the 1980s caused rolling strikes, locked workers out of their jobs and damaged investment confidence. “Returning to that kind of confrontational bargaining model would destroy WA’s ability to attract capital for the pipeline of new projects required to protect jobs and safeguard the taxes and royalties that underpin our economy and every Western Australian’s standard of living. “Union activity in the resources sector has surged since industrial relations reforms enacted by the Albanese Government. “That is why the CME has recommended unwinding many of the changes, including multi-employer bargaining, the ability for unions to initiate bargaining without majority employee support and allowing union officials to enter worksites without being subject to a ‘fit and proper person’ test.” State Opposition leader Basil Zempilas challenged the WA Government to draw a line in the sand. “If Roger Cook wants to back the WA mining sector, he needs to stand up to the MUA and get them to halt their action which will impact exports out of the Pilbara,” Mr Zempilas said. “Roger Cook also needs to get the Prime Minister to reverse the laws which has allowed the unions to disrupt the mining sector in the Pilbara.” WA Ports Minister Stephen Dawson said he encouraged “both parties to continue to negotiate in good faith and reach a solution”. “In the event of any protected action, PPA has advised there would be minimal impact on port operations,” he said. MinRes and Atlas Iron declined to comment.
