Mitchell Sean Race: Mongol declared unfit for trial after being assaulted months after botched home invasion

A Mongols bikie was assaulted and left with a traumatic brain injury — making him unfit to stand trial — months after he was accused of a violent home invasion that saw an innocent father and daughter attacked in a case of mistaken identity. Mitchell Sean Race, 31, is accused of posing as a police officer and pretending to execute a search warrant at a Como unit when he allegedly forced his way inside with another man on November 20, 2023. The terrifying circumstances of the attack on Eric Street was revealed by the gang crime squad days later at a press conference. A 34-year-old female resident, who initially confronted the men, was allegedly hit on the head with a tomahawk axe and suffered a suspected skull fracture and a wound to her scalp. She was allegedly struck twice and left with a 6cm laceration on her head that required 10 stitches. Her 75-year-old father was also injured when he was knocked to the floor and suffered grazing and bruising to his arms and legs. The two offenders, wearing masks and dressed in all black, fled the home after realising they had targeted the wrong unit. Race was arrested by officers from the gang crime squad more than a week after the home invasion before being charged with aggravated home burglary, impersonating a public officer, unlawful wounding and aggravated assault. In a dramatic turn of events, The West Australian can reveal that Race became a victim of assault months after being charged in March 2024. During a District Court hearing hearing earlier this month, Judge Martin Flynn ruled that Race was unable to stand trial on a range of offences as a result of a brain injury. Judge Flynn said he was assaulted on March 16, 2024, before an MRI at Royal Perth Hospital confirmed a traumatic brain injury. He spent nine weeks at RPH and an additional seven weeks at Fiona Stanley Hospital. Judge Flynn said Race had remained in the care of his parents since after being discharged from FSH. The circumstances surrounding the assault on the Mongols member and his current status within the outlaw gang is unclear. Judge Flynn said a special proceeding hearing will take place at a later date after Race was found to be unfit for trial and on the basis he will not become fit within six months. “The accused’s test results are said to be consistent with his severe brain injury sustained earlier in 2024 and were said to demonstrate profound impairments across all cognitive domains assessed,” Judge Flynn said. “I am also satisfied that because of his traumatic brain injury the accused is unable to properly defend the drug charges or the violence charges.” Court records show Race is also facing a dozen more charges related to a search warrant conducted on his Cooloongup property after the home invasion. Police allegedly located $18,000 in cash, a knuckle dagger weapon, a loaded revolver handgun, ammunition, cannabis, steroids, methamphetamine and drug paraphernalia. Those charges are listed for next appearance next month. Race was also charged with the possession of a trafficable amount of methamphetamine with intent to sell and supply after more than half a kilo was found in his rear yard in the months prior to the home invasion. In August 2023, police allegedly found 595g of the drug in an unlocked toolbox of a trailer parked at the rear of his property. Judge Flynn said a legal concern about that methamphetamine charge, expected to be raised at trial by his high-profile lawyer Michael Tudori, was whether the State could rule out whether an “ex-fiancé of the accused’s girlfriend was in sole possession of the methamphetamine located in the trailer”. He is also facing a charge related to the attempted sale or supply of cannabis. During a brief appearance in Perth Magistrates Court in December 2023, Race was spotted with a large Mongols tattoo on the left side of his head. He also flaunted a “one percent” tattoo inked across his throat. The gang crime squad subsequently charged him with displaying the banned insignia before he was fined $1000 plus court costs.
