Jackson Gilmour death: Three men charged after Rye double shooting

The girlfriend of a man killed in a horror home invasion has told a court his housemate “rinsed him of $5,000” and was associated with people who were “bad news”. Jackson ‘Jack’ Gilmour, 29, was shot dead in the early hours of the morning at his Rye home on Victoria’s Mornington Peninsula on December 2 last year. Charlyze ‘Charlie’ Hayter, 19, one of the group that entered Mr Gilmour’s home about 4am, was also killed in the gunfire. Three men accused of Mr Gilmour’s murder faced the Melbourne Magistrates Court on Monday for the start of a four-day committal hearing in which a magistrate will decide if the case should be sent to trial. These are Mason Matticoli, 24, Jarod Smit, 25, and Tyler Vandesteeg, 29. Called to give evidence, Mr Gilmour’s girlfriend said the couple had woken with a start after hearing banging, with Mr Gilmour going to investigate while she barricaded herself in the toilet. “He told me to go back to sleep because it was probably the dog,” she said. “Then we both heard the glass smash and we both became concerned.” She said she overheard a male voice say “we’ve got a gun” as she shut the door and called triple-0. Under questioning, the woman said she’d been dating Mr Gilmour for about 10 months and was aware he was both a user and dealer of illicit drugs. She said she arrived at the house about 12.25am and put herself to bed, waking at about 3am to find Mr Gilmour asleep under his car outside where she encouraged him to go to bed. He appeared to be significantly affected by drugs at that point, the woman confirmed. Mr Gilmour’s girlfriend said he had previously told her he was concerned about his safety and had shown her a BB gun, with her assuming it was to do with Ms Hayter. “He said Charlie had rinsed him of $5,000 … that’s all I remember,” she said. “Jack had said about Charlie the people she hung out with were bad news and lived in Frankston.” She confirmed Mr Gilmour had said this “months earlier when she (Ms Hayter) started living with him”. After police arrived, she said she was led through the house and saw Mr Gilmour lying on the ground with a shotgun on his chest. One of the first police officers on the scene, Acting Sergeant Jack Henderson, told the court he entered the home, locating a woman’s body in the hallway and brass shell casings. While clearing a home, another officer yelled out “man with a gun”, with Sergeant Henderson arriving and finding Mr Gilmour dead in the bedroom. He said a shotgun was “broken open” and empty, with two yellow shotgun cartridges located in the hallway. Also called to give evidence, Mr Gilmour’s neighbour said woke to a “smashing sound” and later heard what sounded like three gunshots. “Within seconds of waking I knew something was wrong,” the woman said. She told the court she heard Mr Gilmour’s voice “yelling loudly ‘where’s the money, where’s the keys, where’s my f--king phone’,” before the first shot. After the first shot she said she heard a secondary male voice say “I’m going to f--king kill you” before two successive shots, believing it to be coming from outside the house. Barrister John Desmond, acting for Mr Matticoli, suggested the threat to kill was a “misconstrued” memory, saying it appeared in the neighbour’s second statement to police but not her first. “I deny that, sir,” the woman said. She said she suspected Mr Gilmour was involved in illicit activity, with people “coming and going from the house at all hours”. The hearing will continue on Tuesday.
