David Jonathon Yarran: Bail denied for man who faces charges over alleged “sustained” domestic violence

A Narrogin man accused of violently stabbing walls and a mattress in a “sustained course of conduct” against his alleged victim has been denied bail. David Jonathon Yarran, 33, appeared in Albany Magistrates Court via video link from Albany Regional Prison on Thursday on 13 charges relating to being armed, criminal damage and domestic violence offences. Legal Aid lawyer Wendy Stewart requested an adjournment and made a bail application for Mr Yarran with the conditions that he reside at a Narrogin residence, observe a curfew, report to police, stay away from the victim and refrain from alcohol. Mr Yarran is accused of lifting the victim up while holding her in a headlock and threatening to throw a chair at her in the early hours of August 19. He also allegedly stabbed holes in the walls and a mattress. Police prosecutor Sgt Matt Hartfield said the victim provided a statement to police on the night of the alleged offences and police have photos of her injuries, including a red mark around her neck. Ms Stewart provided the court with an affidavit signed by the victim on September 3 that said the evidence she gave on the night of August 19 was incorrect as she was emotional, intoxicated and confused and that police took advantage of her “unstable” state. Magistrate Erin O’Donnell said she was concerned the victim was having second thoughts and that the victim’s attempt to blame police was “unfair”. Ms O’Donnell rejected the affidavit on the basis that “complainants do fluctuate on charges like this” and said the victim would need to clarify any details with police. Sgt Hartfield said there was an “extreme risk” that Mr Yarran’s behaviour could continue if granted bail given his history of bail breaches and previous alleged domestic violence offending. Ms O’Donnell said the serious offences were allegedly committed while on bail for a serious offence and described the alleged offences as a “sustained course of conduct” on August 19. Mr Yarran’s bail was denied and he will next appear in Narrogin Magistrates Court on September 17 via video link.
