Shire of Northampton takes action to stop squatting, as residents continue to live in non-habitable dwellings

The Shire of Northampton says it will take legal action against landowners and occupants who live or allow someone to live on property where there is no habitable dwelling. It comes as the shire says community members in Northampton and Kalbarri continue to reside in locations where there is no dwelling, such as in sheds, transportable buildings, caravans and tents, either permanently or temporarily. Some outbuildings, it is alleged, have even been modified to facilitate unauthorised occupancy. As a result, the council has formally adopted a motion to issue warrants, demolition orders, court orders and fines to those who fail to move on. Shire president Liz Sudlow said there had been a strong demand for housing across the shire for some time and when cyclone Seroja made landfall in April 2021, it only exacerbated the crisis. “There are people that are living in a shed, maybe it’s on a weekend, maybe it’s permanently, and to be fair after the cyclone there was quite a bit of that going on,” she said. “The shire took an understanding approach . . . but shire officers are saying to people this is not okay now and they need to find other other arrangements.” Residing in a place where there is no habitable dwelling could be committing an offence under several Acts, including the Building Act and the Health Act, when there is no toilet connected to approved drainage systems. At last week’s ordinary council meeting, councillors carried the motion 7-0, which noted the CEO would be taking action where there is ongoing non-compliance. Landowners and occupiers will be given 21 days notice to vacate the premises and undertake any required demolition work.
