Westside Vaperz shop in Kewdale forced to close amid McGowan Government’s anti-vaping crackdown

A vape store owner claims he has been forced to close his doors, while another nine shop owners have been sent breach notices by the Health Department, as the McGowan Government continues its anti-vaping crusade. Westside Vaperz in Kewdale was ordered to stop selling e-cigarettes just days after The West Australian highlighted parents’ and residents’ concerns about its proximity to Carlisle Primary School. Owner Sam Maharaj, who owns three Westside Vaperz shops, believes his Kewdale store is the first to be targeted under the State Government’s anti-vaping initiatives, including enforcing existing laws banning the sale of e-cigarette devices and a new education campaign aimed at scaring teenagers away from taking up the habit. Mr Maharaj said he felt “totally railroaded” by the Health Department breach notice he received last week ordering him to “cease selling electronic cigarettes/vaping devices from your shop within seven days.” That left him no alternative but to close the shop, he said, because he had nothing else to sell apart from “the cans of drink in my fridge”. The West previously revealed parents and residents near Carlisle Primary School had been battling for the past year to have their concerns heard about the shop, believing it could normalise vaping for young kids. Mr Maharaj, who also owns Westside Vaperz shops in Gosnells and Morley, was one of around 3000 retailers who received a letter from the Health Department in April as it stepped up its surveillance on the sale of e-cigarettes. That letter reminded business owners it was illegal for retailers to sell e-cigarette devices and their components in WA, whether they contain nicotine or not. In Australia, it is illegal to sell, supply or possess nicotine vaping products without a doctor’s prescription. Since then, the Health Department said it had issued 10 letters to retailers relating to breaches of legislation regarding the sale and possession of nicotine vapes. Mr Maharaj, who was threatened with an $80,000 fine if he continued to sell vaping devices and components, said he was confused by the breach notice because he believed his business had not broken any laws. “If this is the law then why wasn’t I, or anyone, breached by the department after the first visit? I’ve had three visits by inspectors over four years and everything has been fine,” Mr Maharaj said. “If this law was there from the beginning why would I sign three leases? Why would anyone be able to open a (vape) store? It’s just stupid. “They are taking something away from me and my staff here, but we are 100 per cent a legitimate business.” It comes as the Small Business Development Corporation confirmed it was looking into the effect of the government’s crackdown on businesses selling vape products. Small Business Commissioner David Eaton said the SBDC was aware of the issues surrounding the enforcement of the Tobacco Product Control Act 2006 and was looking into “the impact of enforcement of the legislation on Western Australian small businesses”. Mr Maharaj fears if all vaping stores are shut down, then more vape products will be sold on the black market. “I have done nothing illegal. . . I wouldn’t be in the industry for so long if I had,” he said. “The black market is going to explode now if they start shutting down stores, and that is so dangerous.” WA schools have reported a big increase in the number of students vaping on school grounds in the past 18 months, prompting Education and Health ministers Sue Ellery and Amber-Jade Sanderson to launch an education campaign and anti-vaping toolkit to combat the use of e-cigarettes by school students.
